Thank you for choosing SciAll Biomedical Online Analysis Cloud Platform (hereinafter referred to as SciAll), operated by Hebei Chengfang Information Technology Co., Ltd. This Agreement specifies the rights, obligations, and terms of service between SciAll and users (hereinafter referred to as "User" or "You", including but not limited to individuals, teams, etc.), forming a legally binding contract. We strongly recommend that you carefully read and understand all terms before registration. SciAll reserves the right to modify service content when necessary without additional user notification. If you disagree with the modifications, you may cancel your platform services. Continued use of the platform services signifies acceptance of all new terms. Please note that SciAll may adjust or interrupt services at any time without special notice. If you have any questions about any terms in this Agreement, please consult our relevant business departments for detailed explanations. This Agreement applies to all SciAll services under Chengfang Technology.
I. User Rights and Responsibilities
1. User Registration
Before using SciAll services, users must provide valid contact information: contact details, email address, and set a sufficiently secure password. All information you provide to SciAll will be protected by SciAll's Privacy Policy. You have the responsibility and right to update your registration information on the account profile settings page.
2. Account Usage
Account usage rights are exclusively for the purchaser. Registered users may not transfer, lend, rent, sell, share, or otherwise transfer the account and password to any third party.
3. User Conduct
If a user's use of SciAll services does not comply with this Agreement, SciAll has the right to make independent judgments upon discovery through notifications, reports, etc., and may immediately terminate provision of some or all services to the user without prior notice.
If users disseminate or spread reactionary, obscene, or other information violating national laws and regulations through SciAll cloud services, system records may be used as evidence of user violations. If user uploads or disseminates such content resulting in claims from third parties or any damages or losses, users shall bear full responsibility.
II. Service Content
1. :app_name Services
SciAll cloud platform is an online platform providing data management and analysis services through technical means. The service itself does not modify or edit user-transmitted content.
2. User Understanding
SciAll may restrict some or all users from accessing or using parts of our services for a period of time. The website and/or services may be unavailable for periods due to maintenance, equipment issues, or other reasons.
SciAll services only provide related network services. Users are responsible for equipment (such as personal computers, mobile phones, and other devices connecting to the internet or mobile networks) and costs (such as phone charges, internet fees, or fees from mobile network usage) associated with using such services.
III. Ownership
1. Platform Ownership
Except for content uploaded and distributed by users, SciAll cloud services and all its components, including but not limited to all content, data, technology, software, code, user interface, and all related derivative works and user information, may not be published, displayed, modified for publication or republication purposes, or used for any other commercial purposes on any medium without SciAll's permission. SciAll assumes no legal or financial liability to users or any third parties for any delays, inaccuracies, errors, omissions, or resulting damages during transmission or submission of all or part of such information.
2. Software Ownership
All rights to any software used by SciAll cloud to provide analysis services (including but not limited to any code, images, photos, animations, videos, recordings, music, text and additional programs, related help materials, etc.) belong to the copyright owner of that software. Without permission from the copyright owner, users may not reverse engineer, decompile, or disassemble, nor attempt to explore source code or implement any actions that may infringe copyrights.
3. Trademarks
Service trademarks and brand SciAll, including but not limited to "SciAll" and SciAll logo, are owned by our company. Any other trademarks, service marks, logos, or third-party business names appearing in the service are the property of third parties. Users may not copy or use these trademarks, marks, or trade names without written consent from the owners.
IV. Data Rights and Responsibilities
1. Data Submission
Users have the right to submit data to SciAll at any time according to this Agreement, but must ensure such data complies with applicable laws and regulations. For successfully submitted data requiring processing, you grant SciAll non-exclusive rights to aggregate and process the data.
2. Data Content
Users must not abuse SciAll services. Any information, materials, text, software, music, audio, photos, images, videos, user registration data, or other materials (collectively "Content") uploaded, posted, sent via instant messaging, email, or transmitted by any other means through this service, whether publicly or privately transmitted, are the responsibility of the content provider and user. As a data management and analysis service platform, SciAll cannot control content transmitted through this service nor comprehensively monitor user behavior, and therefore cannot ensure content legality, accuracy, completeness, authenticity, or quality. Users understand that they must evaluate and bear all risks independently without relying on SciAll services.
3. Data Monitoring
SciAll reserves the right to monitor user use of SciAll network services. If users are found violating any provisions of this Agreement while using SciAll services, SciAll may require users to make corrections or directly take measures deemed necessary by SciAll (including but not limited to modifying or deleting user-uploaded content, suspending or terminating user rights to use network services) to mitigate the impact of improper user behavior.
V. Commitments and Guarantees
Users guarantee that content uploaded to SciAll services must not and is prohibited from directly or indirectly:
- Using SciAll cloud services to upload, post, transmit, or otherwise disseminate content containing any information violating national laws, regulations, or policies; harmful, threatening, abusive, harassing, defamatory, vulgar, offensive, obscene, pornographic, lewd, nationally divisive, or hurting national feelings, or other content deemed inappropriate by SciAll;
- Interfering or attempting to interfere with the normal operation of any part or function of SciAll services or website in any way;
- Submitting user content that you know to be false, misleading, untrue, or inaccurate;
- Accessing computer information networks or using computer information network resources without permission; deleting, modifying, or adding to computer information network functions, stored, processed, or transmitted data and applications; intentionally damaging programs or endangering computer information network security;
- Publishing content that infringes on others' copyrights, trademarks, or trade secrets;
- Displaying or otherwise providing any user information to non-original users without prior consent from the original user;
- Impersonating others without authorization or gaining access to SciAll services; or personally identifying users without their explicit consent;
- Publishing spam advertisements or illegally promoting products or services;
- Promoting, inciting, or participating in any multi-level marketing or pyramid schemes, or posting malicious harassment messages on forums obtained through services.
If users violate any of the above commitments, depending on the severity of the violation, SciAll has the authority to issue warnings, restrict posting, or cancel usage rights. If user violations cause losses to SciAll cloud services, SciAll users, or any partners, users must bear full legal responsibility and provide corresponding compensation for damages.
VI. Intellectual Property Protection
If user-uploaded content allows other users to use services, download, view, listen, or otherwise access or disseminate, users must ensure their published content and related actions comply with intellectual property laws, regulations, and copyright policies, including but not limited to:
- Upon receiving infringement notices, users should immediately delete or prohibit access to allegedly infringing content and immediately contact the notifying party for detailed information.
- Users understand and agree that SciAll will handle formal infringement notices submitted by third parties according to relevant laws and regulations, and will delete or prohibit access to allegedly infringing content upon request. SciAll will take appropriate policy measures and strive to prevent repeated infringement under similar circumstances.
VII. Privacy Protection
SciAll highly respects user privacy. All information you provide during registration will be strictly protected by SciAll's privacy policy. SciAll will never disclose or reveal non-public content stored by users in SciAll cloud services to third parties, except in the following circumstances:
- To protect and maintain SciAll's trademark rights, patent rights, and all other legitimate rights and interests;
- If required by relevant laws, regulations, or SciAll cloud service legal service procedures;
- If other situations necessitate legally disclosing, editing, or revealing personal information.
VIII. Disclaimer
Given the nature of network services, you acknowledge that during use of SciAll services, service interruptions may occur due to force majeure and other risk factors. If SciAll services are free, SciAll need not notify users in advance when making changes, interruptions, or terminations. In such situations, SciAll will promptly handle and repair, but within the scope permitted by law, we need not bear any liability to any user or third party for any resulting losses.
Within the scope permitted by law, SciAll bears no responsibility for service interruptions or obstructions caused by the following circumstances, including but not limited to:
- During SciAll's open testing period, program errors may exist. If user data is lost due to such circumstances, SciAll services need not bear any responsibility. During the open testing period, users should properly back up uploaded data and analysis results;
- SciAll services may change services or delete partial functions at any time for any reason, may cancel or terminate services to users at any time, and decisions to cancel or terminate services need not be justified or communicated to users. Once services are cancelled, user rights to use services immediately terminate, and any information stored by users in services may be unrecoverable;
- SciAll services require regular or irregular maintenance of platforms or related equipment providing network services. If paid network services are interrupted for reasonable periods due to such circumstances, SciAll services need not bear any responsibility, but SciAll services should notify in advance when possible;
- User computer software, systems, hardware, and communication lines malfunction;
- Damage from computer viruses, trojans, other malicious programs, or hacker attacks;
- Improper user operation, or users using services through non-SciAll authorized means;
- Other circumstances beyond SciAll's control or reasonable foresight.
You understand and agree that during use of services, you may encounter risks from network information or other user behavior. SciAll assumes no responsibility for the authenticity, applicability, or legality of any information, nor for damages caused by infringement. These risks include but are not limited to:
- Anonymous or impersonated messages containing threatening, defamatory, offensive, or illegal content from others;
- Any psychological, physical, or economic losses caused or potentially caused by misleading, deception, or other factors resulting from service use;
- Disputes or losses resulting from users authorizing third parties (including third-party applications) to access/use SciAll service space content should be borne by users themselves and are unrelated to SciAll;
- Other risks arising from network information or user behavior.
SciAll has the right to handle illegal or non-compliant content, but this right does not constitute an obligation or commitment by SciAll. SciAll does not guarantee timely discovery of illegal behavior or corresponding handling.
IX. Other Provisions
- SciAll reserves final interpretation rights for this Agreement.
- This Agreement takes effect upon publication. SciAll may modify agreement content at any time, with modifications published on the SciAll service website. If you disagree with SciAll's modifications to this Agreement, you have the right to stop using network services. Continued use of network services signifies acceptance of SciAll's modifications to this Agreement.
- SciAll may notify users through website announcements, email, text messages, or regular mail. Such notices are deemed delivered on the date sent.
- This Agreement's formation, execution, interpretation, and dispute resolution shall apply Chinese law and be subject to Chinese court jurisdiction. If disputes arise regarding agreement content or execution, parties should attempt friendly negotiation. If negotiation fails, either party may file suit at the people's court in SciAll's location.
- This Agreement constitutes the complete agreement between parties regarding matters covered and other related matters. It grants no rights to parties beyond those specified herein.
- If any provision of this Agreement is wholly or partially invalid or unenforceable for any reason, the remaining provisions shall remain valid and binding.
- If these terms are translated into other languages including English, any conflicts or ambiguities shall be resolved according to the Chinese version.
